The MetroPipe User Agreement

1. By using MetroPipe.net services, you agree to terms of this user agreement. If you do not agree, do not use MetroPipe.net services.
2. You certify that you will use MetroPipe.net services only for purposes not associated with force, fraud, or intrusion and/or impositions to others.
3. Each user is solely responsible for his or her transmissions through MetroPipe.net.
4. You agree not to use the service for the purposes of sending hate mail, spam, bulk mail, or any other harassing, libelous, abusive, threatening, harmful, annoying, or offensive email.
5. MetroPipe.net may terminate your access to the Service and any related service(s) at any time, for what MetroPipe.net considers a violation of its terms of service or statement of ethics.
6. You agree to not interfere or disrupt any networks connected, or not connected, to the MetroPipe.net service.
7. MetroPipe.net retains the right at any time to change or discontinue any aspect of the MetroPipe.net site or service. The sole remedy is for users to discontinue their use of MetroPipe.net.
8. By using MetroPipe.net, you are stating that you are an adult, that you have read and understood this agreement, and that you agree to be bound by it. MetroPipe.net reserves the right to terminate your use of the service if MetroPipe.net learns that you have used the service for illegal purposes or have violated either this agreement or our statement of ethics. All fees paid in advance of termination are non-refundable.
9. You are responsible for obtaining and maintaining all computer hardware, communications access, communications equipment, and any other equipment needed for access to and use of MetroPipe.net, including all charges related thereto.
10. Neither MetroPipe.net, its affiliates, employees, agents, third party content providers nor licensors warrant that MetroPipe.net will be uninterrupted or error free; nor do they make any warranty as to the accuracy, completeness, or reliability or any information, advertisements, services or merchandise provided through MetroPipe.net, directly or indirectly, or as to the results that may be obtained from use of MetroPipe.net.
11. The information and services included in or available through the MetroPipe.net service may include inaccuracies or errors. MetroPipe.net may make improvements and/or changes to the Service at any time without notice.
12. MetroPipe.net is provided on an as-is basis. MetroPipe.net expressly disclaims all warranties of any kind, expressed or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement.
13. MetroPipe.net will be liable for no damages or injury caused by any failure of performance, error, omission, inaccuracy, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of MetroPipe.net, under any legal theory or cause of action.
14. You agree to indemnify, defend and hold harmless MetroPipe.net, its affiliates, officers, directors, employees, and agents from any and all third party claims, liability, damages and/or costs (including attorneys fees) arising from your use of MetroPipe.net, your violation of this user agreement, or your infringement of any intellectual property or other right of any person or entity.
15. The governing law for this agreement is The Common Economic Protocols, version 1.0. There is no state jurisdiction for this agreement. Any disputes arising from this agreement shall be resolved by an independent arbitrator, and not under the auspices or authority of any nation-state government.
16. These terms of service will inure to the benefit of MetroPipe.net s successors, assigns and licensees. Any waiver of any provision of these terms of service will be effective only if in writing and signed by an authorized employee duly acting in an official capacity. If for any reason any provision or portion of these terms of service is found to be unenforceable, the remainder of these terms of service will continue in full force and effect.
17. MetroPipe.net will honor current prices at the time of order placement only.
18. Any rights not expressly granted herein are reserved.
